Following Terms and Conditions (“Terms”) govern your access to and use of our website, programs, services and content. By accessing, purchasing, registering for, or otherwise engaging with our services, you agree to be bound by these Terms. If you do not agree with these terms, we ask that you refrain from using our website or services.

1. Definitions

  • “Company”, “we”, “our”, or “us” refers to the sole proprietorship operating under the registered business names Percepta Leadership and the Center for Applied Psychodynamics. Both names refer to the same legal business and are not separate legal entities. Any reference to Percepta Leadership in these Terms includes the Center for Applied Psychodynamics, and vice versa, unless otherwise specified.

  • “User”, “you” means any individual or entity accessing or using our services.

  • “Services” include executive coaching, psychotherapy, coach training programs, certification offerings, free resources, and website content.

2. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to access our services. By using our site or enrolling, you represent that you meet these criteria. You are responsible for ensuring that your participation in our services complies with all laws and regulations in your jurisdiction.

3. Services Overview

Percepta Leadership offers:

  • Executive and Business Coaching 

  • Psychotherapy Services (available only in locations where we are authorized to provide them, and delivered exclusively by qualified, registered professionals in accordance with applicable laws and regulations) 

  • Training Programs (through the Center for Applied Psychodynamics) 

  • Related Resources (e.g., guides, blogs, webinars) 

These services are not substitutes for legal, financial, medical, or crisis intervention services. If you are in crisis or in need of immediate medical assistance, please contact emergency services in your area. 

Services may not be available in all locations due to legal or regulatory restrictions. It is your responsibility to ensure that your participation complies with local laws in your jurisdiction.

4. Payment Terms

Fees for our services vary depending on the type of service provided.

  • Training Programs, Courses, and Workshops — Full payment is due at the time of registration. Enrollment is confirmed only upon successful receipt of the full payment.

  • Individual Coaching Sessions or Packages — Payment is due in full at the time of booking (for single sessions) or at the start of the engagement (for packages or retainers).

  • Psychotherapy Services — Payment is due at the end of each session, unless otherwise agreed in writing.

Percepta Leadership, including its divisions, does not offer installment plans, deposits, or deferred payments. All payments are non-refundable, except where otherwise required by law. We reserve the right to deny access to program materials, sessions, or future bookings if payment is not received when due. Fees are listed in Canadian dollars unless otherwise stated.

5. Refund and Cancellation Policy

All payments are non-refundable, except where otherwise required by law. By enrolling, you acknowledge and agree that you will not be entitled to a refund once payment has been processed, regardless of your participation or completion of the program.

If we are unable to deliver the services as described due to circumstances within our control, we will either reschedule the service or provide a reasonable alternative. Nothing in this policy affects your rights under the Ontario Consumer Protection Act or other applicable laws.

6. Professional Boundaries

Coaching services offered by Percepta Leadership are not psychotherapy, mental health counselling, or medical treatment. Psychotherapy services are provided only by qualified professionals who are registered or licensed in the applicable jurisdiction, and only to clients located in jurisdictions where such services are legally permitted. Where psychotherapy is provided, it is subject to all applicable regulatory requirements, professional codes of ethics, and privacy laws.

7. Intellectual Property

All content on our website and within our programs; including videos, worksheets, frameworks, branding, and written materials; is owned by Percepta Leadership, including its divisions such as the Center for Applied Psychodynamics, unless otherwise stated. No portion may be copied, reproduced, distributed or modified without written consent. All names, logos, program titles, and taglines associated with Percepta Leadership and its divisions are trademarks of Percepta Leadership.

8. Confidentiality

We maintain strict confidentiality of all coaching and therapy sessions in accordance with ethical standards and applicable privacy laws. Exceptions apply in cases of imminent harm, abuse reporting or as required by law. Confidentiality extends to communications via email, phone, video conferencing, and other electronic means, though we cannot guarantee the security of information transmitted through these methods.

9. User Conduct

You agree to use our services, website, and materials only for lawful purposes and in a manner consistent with these Terms. You will not:

  • Engage in disruptive, abusive, harassing, or discriminatory behavior toward our staff, contractors, or other participants, whether in person, online, or via electronic communication.

  • Infringe upon or misappropriate our intellectual property, including copying, reproducing, or distributing our content without permission.

  • Use our services, content, or platform to promote harmful, defamatory, or illegal activities.

  • Attempt to interfere with the operation or security of our website, systems, or services.

We reserve the right to suspend or terminate your access to our services without refund if we determine, in our sole discretion, that your conduct violates these Terms or applicable laws.

10. Disclaimer

All services are provided in good faith and without guarantees of specific outcomes. Coaching and training are educational in nature and are not a substitute for psychological counseling, psychotherapy, medical care, or legal advice. Psychotherapy services are provided only by qualified professionals in jurisdictions where such services are legally permitted and in accordance with applicable laws and regulations.

11. Limitation of Liability

For Coaching and Training Services
Coaching and training services are educational in nature and are not a substitute for psychotherapy, psychological counseling, legal, financial, or medical advice. No specific outcomes are guaranteed. You are solely responsible for any decisions or actions you take as a result of participating in these services. To the maximum extent permitted by applicable law, Percepta Leadership, including its divisions such as the Center for Applied Psychodynamics, employees, and contractors shall not be liable for any indirect, incidental, or consequential damages arising from the use of coaching or training services or related content.

For Psychotherapy Services
Psychotherapy services are provided only by qualified professionals in jurisdictions where they are legally permitted to practice. These services are delivered in accordance with applicable professional, ethical, and legal standards. While every effort is made to provide appropriate and effective care, no specific results can be guaranteed. To the maximum extent permitted by applicable law, Percepta Leadership, its divisions, employees, and contractors shall not be liable for any indirect, incidental, or consequential damages arising from the use of psychotherapy services, except where such limitations are not permitted by law.

12. Third-Party Links

We may link to external sites for additional resources. We are not responsible for the content or accuracy of these sites.

13. Modifications

We may revise these Terms at any time. Continued use after changes implies acceptance. We recommend reviewing this page periodically.

14. Governing Law

These Terms shall be governed by and interpreted under the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

15. Dispute Resolution

Any dispute, claim, or controversy arising under or relating to these Terms, the services provided, or any related agreements shall first be addressed through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation, the parties agree to submit the matter to mediation in Ontario, Canada, with a mutually agreed mediator, before pursuing any court action. This clause does not prevent either party from seeking urgent injunctive or equitable relief where necessary to protect their rights.
